• PIOs require prior permission of RBI to sell properties to another PIO

  • NRIs and PIOs require prior permission of RBI to mortgage their property with a foreign bank

  • Foreign national resident in India who is a citizen of another country require prior RBI approval to sell or gift or mortgage immovable properties to person residing in India or NRI or PIO

  • The branch office of a foreign company can acquire any immovable property in India, which is necessary for or incidental to carrying on such activity by payment through foreign inward remittance in accordance with Foreign Exchange Management (Establishment in India of Branch or Office or other Place of Business) Regulations, 2000. A declaration in form IPI should be filed with the Reserve Bank within ninety days from the date of acquiring the property.

  • Foreign Embassies / Diplomats / Consulates General may sell immovable property (other than agricultural land/ plantation property/ farm house) in India subject to obtaining clearance from the Government of India, Ministry of External Affairs
