When the owner of the land who intends to develop his land for any purpose other than that earmarked under the approved Master Plan, then the owner has to apply for change of land use before the concerned authority for the consideration.


For instance, when a land bearing a survey number coming within the jurisdiction of a town planning authority, i.e. the Bangalore Development Authority ("BDA"), and the land is earmarked in the Comprehensive Development Plan ("CDP") for residential zone. In case, the owner of the land intends to use it for industrial purposes, then he is required to obtain permission from the Bangalore Development Authority for change of use under Section 14-A of the Karnataka Town and Country Planning Act, 1961.

If the change of land use is sought from commercial or industrial to residential or from industrial to commercial uses and purposes, the planning authority will collect a stipulated fee and on such collection, the change of land use shall be deemed to have been granted.
